DCNF(DCNF)—Radio host Charlamagne Tha God suggested Wednesday that if President Donald Trump accepts a Boeing 747-8 reportedly being gifted to the United States, slavery could make a comeback in America.

Qatar offered the president the $400 million plane for modification into a VC-25 configuration to serve as Air Force One, which would subsequently be donated to Trump’s presidential library following the end of his second term. Charlamagne, on “The Breakfast Club,” said the gift would violate the Constitution’s emoluments clause because it prohibits office holders from receiving presents “from any King, Prince, or foreign State,” arguing that if Trump was willing to breach the Constitution, what would stop slavery from being implemented again.

“It’s unconstitutional. You cannot take the plane … Full stop … We got to stop having this conversation like, maybe he can, maybe he can’t,” Charlamagne said. “No. It’s actually just unlawful to do. Like, he’s not supposed to do it. It’s unconstitutional.”

However, noted attorney Alan Dershowitz on Tuesday said Trump would probably be able to keep the plane as the emoluments clause would not prohibit the gift due to it being slated to go to the United States government.

“If we’re in a post-Constitutional society, I can’t wait to tell y’all how screwed we are … you ready to be a slave? Because if we just saying F the Constitution, you ready to be considered three-fourths of a human again?” Charlamagne asked his co-hosts.

Charlamagne appeared to be referencing a clause in Article 1, Section 2 of the Constitution, which counted black slaves as three-fifths of a person.

Trump faced multiple lawsuits alleging that he breached the emoluments clause during his first term focusing on hotels owned by his company. The suits were ultimately struck down by federal courts.

“Now this means no person shall receive the gift. We know that gifts are given to governments all the time … when you go to the Oval Office, where the White House, you see all over the place, gifts that have been given by foreign governments to the White House, great portraits of Winston Churchill and other things that are gifts the British government or other governments have been given to the United States,” Dershowitz said. “But when the incumbent president or any officer leaves, he doesn’t take the gifts with him, he leaves them.”

“There have been a couple of occasions where the presidents of taken a few gifts, for example, letters they take letters now letters could be worth a fortune… I think presidents have taken some of those, but mostly they go to the Library of Congress or to the Smithsonian or to the presidential libraries,” he added.

Dershowitz clarified that the National Archives and Records Administration (NARA) operates presidential libraries rather than the former presidents themselves. Therefore, the attorney said the gifting of the plane would not breach the emoluments clause and would be “perfectly constitutional.”
